NOTIFICATION OF CUSTOMER SATISFACTION PROGRAMMay 11, 2009 Dear Customer, If you own an eMachines M68xx Series portable computer that experienced problems with overheating and shutting down, you could benefit from a customer satisfaction program implemented by Gateway. The enclosed Claim Form relates to a customer satisfaction program that Gateway has implemented in order to offer Affected Consumers three tiers of potential benefits. The customer satisfaction program will remain in effect for six (6) months following the date of this notice. "Affected Consumers" refers to each end-user person or entity in the United States who purchased or otherwise acquired, for their own use and not for resale, an eMachines M68xx Series portable computer that experienced problems with overheating and shutting down. Excluded from this definition are: (1) Gateway's employees and their immediate family members; (2) retailers, wholesalers, and other middlemen who purchased the eMachines M68xx Series portable computers for resale; and (3) persons who purchased an M68xx Series portable computer from an original end-user purchaser, e.g., through eBay, CraigsList, and/or Yahoo Auctions. A. Consideration for Affected Consumers Who Had Two or More Repair Attempts
If you have had two or more documented repair attempts for heat-related problems by Gateway or a Gateway-authorized repair facility you will be entitled, upon completion of terms described in detail below, to either (a) a $300 payment upon return of your M68xx Series portable computer to Gateway and confirmation by an independent tester that the portable computer suffers from heat-related problems (Tier 1(a)), or (b) repair of your portable computer by Gateway (Tier 1(b)). If you select option (b) in this tier of the program, and your claim is accepted, you will receive pre-paid portable computer boxes from Federal Express, UPS, DHL, the U.S. Postal Service or a similar carrier for purposes of submitting your portable computer(s) for repair or to return your portable computer(s) to Gateway. Additionally, if the repair of the heat-related issue proves unsuccessful within six (6) months after the repair, you will be eligible to receive the $300 payment provided for under option (a) if you return the portable computer to Gateway (and pay for such shipping) and a third-party tester confirms that the portable computer suffers from heat-related problems. B. Consideration for Affected Consumers Who Had One Repair Attempt

C. Consideration for Affected Consumers Whose M68xx Series Computers Were Not Repaired
If you have not returned your portable computer to Gateway or an authorized Gateway repair facility for heat-related repairs but are experiencing heat-related problems, you are entitled to repair of your portable computer by Gateway upon confirmation of a heat-related problem by a third-party tester. Additionally, if the repair proved unsuccessful within six (6) months after the repair, you will be eligible to receive a $100 payment if you return your portable computer to Gateway (and pay for such shipping) and a third-party tester confirms that the portable computer suffers from heat-related problems. (Tier 3) To receive a prepaid box, after you receive notice that your claim was accepted, you will need to contact Gateway at 6800 Series Satisfaction Program, 610 Gateway Drive, North Sioux City, SD 57049 or 6800SeriesClaims@gateway.com, request such a box and provide security in the form of a valid credit card that you agree will be charged in the event that the portable computer box is shipped to the customer and not subsequently used to ship the portable computer to the designated repair and/or testing facility. If you use the prepaid box to ship the portable computer to the independent testing facility, you will not be charged. Affected Consumers are limited to one claim for each M68xx Series computer. If you believe you are eligible to receive benefits under the customer satisfaction program, please download and complete the Claim Form by following the instructions that are included in the Claim Form and send the completed Claim Form to Gateway. The Claim Form and any supporting documents should be sent to Gateway at the following address and must be postmarked within six (6) months of the date of this notice:
